Right To Repair

Under the Housing (Scotland) Act 2001, Scottish Secure Tenants have the right to have certain small but urgent repairs carried out by their landlord within a given timescale.  These repairs, and the maximum timescale within which they should be completed are as follows:

When reporting a repair, you will be informed by the Association that it is a qualifying repair.  If the Association’s contractor does not attend to the repair within the time limit set, you have the right to either:

  • Instruct another contractor from the Association’s approved list to carry out the work up to a maximum value of £350, or
  • Receive compensation from the Association up to a maximum value of £100.

N.B. The Right to Repair does not apply if access has not been made available or there are exceptional circumstances outwith the control of the Association making it impossible to complete the repair within the maximum timescale.
